SALES TAX AUDIT POINTERS

 

When the NJ Division of Taxation arrives to initiate a sales tax audit the business should anticipate that a Tax Investigator has already "shopped your business," examined your supplier records, weighed your sandwich and mozzarella portions and conducted a desk investigation.  If your business maintains a Liquor License,Tax Investigators may have already initiated a "pour test" to calculate the number of shots sold per bottle.

 

Be prepared!  The following business records are often requested; although not every record the State requests may not be legally required to be maintained:

 

  • General ledgers and journals

  • Cash receipt and disbursement journals

  • Purchase and sales journals

  • Sales tax exemption or resale certificates

  • State tax returns

  • Federal tax returns

  • Purchase Invoices

  • Work papers used in preparation of Sales Tax retrns

  • Any record to prove or disprove filed sales tax returns.

 

The State anricipates that the Restaurant & Pizza Industries will lack adequate records. If your records are incomplete or even non-existent, NOW is the time to contact our firm in order to reconstruct your sales and be prepared for an audit.

 

The Sales Tax Audit is a very tedious and sophisticated investigation of your financial records and often, a supplemental investigation of your living style- a "reality" audit that looks at your personal monthly expenses and lifestyle.

CRIMINAL REFERRAL

 

At any time, It is possible for an Audit to be turned over to the Criminal Investigation Unit of the NJ Taxation and/or the NJ Division of Criminal Justice.  If you have any doubts that the audit could identify criminal tax behavior, we recommend contacting us immediately to protect your rights and interests.

 

SALES TAX APPEALS

 

If you diisagree with a Sales Tax Audit Final Determination there are strict time limits to appeal your case to either the Conferences and Appeals Branch and/or the NJ Tax Court.  Although we recommend that we represent you upon receipt of the audit letter, an aggrevied taxpayer can retain our services for a Tax Appeal.
